As an independent Republic, Scotland can lay territorial claim to waters; however - any inclusion within the EU would largely depend on those waters being available to other European fleets for fishing and farming purposes.
Then again, that is not an exhaustive argument, I'm sure there are many articles written in tiny tiny tiny print that are invisible to the naked eye and that will no doubt be prominent in the years to come.
